Introduction and Scope of this Privacy Notice
This notice explains the privacy practices of Visual Icon and its subsidiaries (collectively, “Visual Icon” or “we”) regarding the collection, use, and disclosure of personal information of VISUAL ICON production candidates, employees, contractors and participants, and guardians for any of those individuals, who are California residents (collectively, “Covered Individuals”). This notice is effective as of January 1, 2023. Terms in this notice that are defined in the California Consumer Privacy Act, as modified by the California Privacy Rights Act (collectively, “CPRA”), are used in this notice as defined in the CPRA. This notice is required by law and does not create an employment relationship between Covered Individuals and VISUAL ICON.

Categories of Personal Information VISUAL ICON Collects
VISUAL ICON collects personal information directly from you and indirectly, such as from prior employers, recruitment and talent agencies, co-producers, television networks, references provided by you, public records sources, and other third parties. We also may obtain personal information as a result of you being on our premises or using our systems. The personal information that VISUAL ICON collects, or has collected from Covered Individuals in the 12 months prior to the effective date of this notice, falls into the following categories established by the CPRA:

• identifiers such as real name, alias, postal address, unique personal identifier (e.g., a cookie), online identifier, IP address, email address, social security number, driver’s license number, state identification number, passport number, or other similar identifiers;
• account log-in information, financial account, debit card or credit card number, security or access code, password, or credential;
• information that may reveal age, gender, race, sexual orientation, religious or philosophical beliefs, union membership, or other protected classifications;
• commercial information;
• internet or other electronic network activity information, including, but not limited to, information regarding use of VISUAL ICON’s equipment, systems and resources (e.g., browsing history), information about your interaction with products, content and services available through VISUAL ICON, contents of mail, email, and text messages, other information you store on VISUAL ICON’s equipment or systems, information collected from security systems or other monitoring, building access records, and device and other asset numbers;
• geolocation data, which may include precise geolocation data (e.g., if your location is tracked during the production of a race);
• professional or employment-related information;
• education information;
• audio, electronic, or visual information (e.g., a photograph), or similar information;
• biometric information; • genetic data;
• sex life or sexual orientation (e.g., if you provide that information through a diversity survey);
• health information (e.g., vaccination records); and
• interferences drawn from any of this information.

Sensitive Personal Information
The categories of data that VISUAL ICON collects and discloses for a business purpose include “sensitive personal information” as defined under the CPRA. VISUAL ICON does not use or disclose sensitive personal information for any purpose not expressly permitted by the CPRA.

How VISUAL ICON Uses Personal Information
VISUAL ICON collects and uses personal information to administer your relationship with, involvement with, or application to VISUAL ICON, including in some or all of the following ways:

• evaluate candidates for employment, contract work or participation in productions;
• provide you with information and otherwise communicate with you and third parties;
• conduct safety and security screenings;
• provide and administer compensation, benefits, and other work-related entitlements and programs (if any);
• manage equipment, systems, and resources owned or used by VISUAL ICON;
• communicate with your designated contacts in the case of an emergency;
• respond to and comply with your requests and inquiries;
• monitor compliance with and comply with applicable laws, regulations and rules, court and government agency orders, VISUAL ICON policies and rules, and agreements; and
• conduct other legitimate business activities.

Each category of personal information collected by VISUAL ICON is generally kept for as long as necessary to fulfill the purposes for which it was collected and in order to comply with legal and regulatory requirements.

With Whom VISUAL ICON Shares Your Personal Information
VISUAL ICON discloses your personal information to third parties who provide services, including payroll, occupational health, and IT services. In providing such services, your personal information may be processed by the service provider on VISUAL ICON’s behalf for the purposes of providing the required service to VISUAL ICON.

We may disclose your personal information to third parties, who may act as controllers in their own right, in other circumstances, including:

• Other producers and financers of VISUAL ICON productions
• Administrative authorities (tax or social security authorities)
• HR services providers
• Recruiting and talent agencies
• Financial institutions
• Insurance organizations
• Governmental organizations or agencies, including law enforcement
• External advisors (such as legal advisors, accountants)
• Employee benefits providers
• Unions and guilds

We may also share your personal information in connection with a substantial corporate transaction, such as the sale of a business asset or line, a merger, consolidation, asset sale, initial public offering, or in the unlikely event of bankruptcy.

You agree and consent (as applicable) to us disclosing your personal information to service providers or other third parties for the purposes set out in this notice.

Categories of Personal Information VISUAL ICON Discloses for a Business Purpose
The personal information that VISUAL ICON disclosed about Covered Individuals to the categories of third parties identified in the “With Whom VISUAL ICON Shares Your Personal Information” section of this notice for a business purpose in the 12 months prior to the effective date of this notice falls within the following categories established by the CPRA:

• identifiers such as real name, alias, postal address, unique personal identifier (e.g., a cookie), online identifier, IP address, email address, social security number, driver’s license number, state identification number, passport number, or other similar identifiers;

No Sale of Personal Information
VISUAL ICON has not sold any personal information, as those terms are defined in the CPRA, any personal information of Covered Individuals in the 12 months prior to the effective date of this notice.

Sharing of Personal Information
The personal information of Covered Individuals that VISUAL ICON may share or may have shared, as those terms are defined in the CPRA, in the 12 months prior to the effective date of this notice falls into the following categories established by the CPRA:

• identifier, such as your email address or unique personal identifier (e.g., a cookie)
• internet or other electronic network activity information

Your Data Rights
You may have certain rights under the CPRA, including to request information about the collection of your personal information by VISUAL ICON, to access your personal information in a portable format, and to correct or delete your personal information. If you, or your authorized agent under the CPRA, wish to do any of these things, please contact VISUAL ICON using the contact information below. Depending on your data choices, certain services may be limited or unavailable. For security purposes, we will generally ask you, or your authorized agent, for information to verify your request.

To exercise your rights under applicable law regarding cross-context behavioral advertising or targeted advertising (as those terms are defined under applicable law), you may use the preference tool available on the applicable Service (e.g., through the “Your Ads Privacy Choices” link in the footer of the website), which will be made available if cross-context behavioral advertising or targeted advertising takes place on or through that Service. Your choices might not be recognized when you use a different device or browser or delete your cookies.

CPRA Non-discrimination Statement
VISUAL ICON will not discriminate against you for exercising your rights under the CPRA.
